Welcome to BootKamp. This website is operated by Fleek Pty Ltd trading as BootKamp ("BootKamp", "we", "us", "our"). By accessing this website and placing an order, you agree to the terms below. Please read them carefully. These terms are governed by the laws of New South Wales, Australia.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot be lawfully excluded.

1. About These Terms

These terms apply to your use of this website and to all orders placed through it. They should be read together with our Refund Policy, Shipping Policy and Privacy Policy, which form part of these terms. Where there is any inconsistency, the more specific policy applies to that subject.

2. Orders & Formation of Contract

• Products offered on this website are an invitation to purchase, not an offer.
• A contract is formed only when we accept your order and issue an order confirmation or invoice. We may decline or cancel an order before that point.
• We may refuse or cancel an order for reasons including unavailability of stock, an error in pricing or product information, suspected fraud, or circumstances beyond our control. If we cancel a paid order, we will refund you in full.
• Made-to-order, custom and vehicle-specific items are manufactured to your specifications once your order is confirmed. Please check your selection carefully, as these items are subject to the exclusions set out in our Refund Policy.

3. Pricing & Payment

• All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
• Prices exclude freight unless stated. Freight and any applicable surcharges are calculated and displayed before you complete your order.
• Prices are subject to change without notice and are confirmed only once your order is paid in full. Paying a deposit does not lock in a quoted price.
• Payment is processed at the time of order through our payment provider. We do not store your full card details.
• We make every effort to ensure pricing and product information is accurate, but errors may occur. Where a genuine error is identified, we may correct it and will contact you before proceeding.

4. Shipping, Title & Risk

• We deliver within Australia. Delivery timeframes and freight are set out in our Shipping Policy.
• Risk in the goods passes to you on delivery to your nominated address.
• Title to the goods remains with BootKamp until payment has been received in full.

5. Consumer Guarantees & Warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Details of how to make a return or warranty claim, and any voluntary warranty we offer, are set out in our Refund Policy. To the extent permitted by law, and other than the consumer guarantees and any express warranty we provide, all other terms, conditions and warranties implied by law are excluded.

6. Product Information & Fitment

• Product descriptions, images, dimensions and vehicle-fit information are provided as a guide and may vary slightly from the actual product.
• It is your responsibility to confirm a product suits your vehicle and intended use before purchasing. Contact us if you are unsure — we're happy to help.
• Products must be installed and used in accordance with any instructions provided and with all relevant laws and Australian Standards. Incorrect fitment, modification or misuse may affect your warranty and, where relevant, ADR compliance.

7. Limitation of Liability

To the extent permitted by law, our liability for any claim arising in connection with the goods or this website is limited, at our option, to the replacement or repair of the goods, the supply of equivalent goods, or the refund of the price paid. We are not liable for any indirect or consequential loss. Nothing in this clause limits your rights under the Australian Consumer Law.

8. Website Use, Accuracy & Third-Party Content

• Every precaution is taken to ensure the accuracy of material on this website, but we do not accept liability for errors or omissions, or for any website linked to from ours. You should make your own enquiries where needed.
• This website may contain content provided by third parties. We do not endorse and are not responsible for third-party content, which you rely on at your own risk.
• You may use this website for personal, lawful purposes only. You must not misuse it, attempt to interfere with its operation, or use it in a way that breaches any law.

9. Intellectual Property

The BootKamp name, logos, product designs, photography, text and other content on this website are the property of BootKamp or its licensors and are protected by law. You may not reproduce, distribute or transmit any of this content without our prior written consent.

10. Changes to These Terms

We may update these terms from time to time. The version in effect at the time you place an order applies to that order. The current version is always available on this website.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
